How workers' comp premium is calculated

Workers' comp premium is based on payroll: each class of work has a rate per $100 of payroll, which is adjusted by your experience modification (x-mod) if you qualify for one, plus policy fees and state assessments. California uses separate classifications for many trades depending on employees' hourly wages, so the class — and the rate — can change with wages.

Who must carry it

Any California employer must carry workers' comp. CSLB also requires it — even with no employees — for C-8, C-20, C-22, C-39 and C-61/D-49 licenses, and for any license qualified by a Responsible Managing Employee. From January 1, 2028, CSLB requires it for all active licenses except joint ventures.

Payroll reporting and audits

You pay an estimated premium at the start of the policy based on estimated payroll. At the end of the term, the carrier audits actual payroll and adjusts the premium up or down. Uninsured subcontractors can be added to your payroll at audit, so keep certificates from every sub.
